Terms and Conditions

By engaging services by Kenny Shack Photo, the client hereby acknowledges and agrees to abide by the terms and conditions outlined in this document. The client's decision to hire Kenny Shack Photo constitutes acceptance of these terms and conditions and forms a binding agreement between the client and Kenny Shack Photo. Any deviations, amendments, or modifications to these terms and conditions must be agreed upon in writing by both parties. Failure to adhere to the terms and conditions may result in the termination of the agreement or the implementation of additional fees or penalties. • Travel fees apply for each trip to and from the property, at a rate of $0.75/mile after the first 30 miles. • A cancellation fee of $100 will be applied to appointments that are canceled with less than 24 hours' notice prior to the scheduled session. • Rush Delivery must be specified at time of booking. • Exterior photographs, and drone imagery are subject to weather conditions and may not always be feasible during the initial session. In such cases, rescheduling of exterior photos will be accommodated based on an hourly rate, in addition to travel fees. • Drone imagery is contingent upon the location of the property. There may be circumstances where a property is situated near an airport or hospital, rendering it unsuitable for drone photography. • All images provided by Kenny Shack Photo are protected by copyright law. The Client is granted a limited, non-exclusive license to use the images for advertising and marketing purposes related to the subject property only. The Client may not sublicense, sell, or otherwise transfer the images to any third party without the prior written consent of Kenny Shack Photo. • Licensing Fees will be charged to individuals not involved in the original transaction for usage of photo sets. Any unauthorized usage will result in a fine of $500 charged to both the original Client and the unauthorized user. • Please note that my photography services do not include cleaning or tidying responsibilities. It is the client's sole responsibility to ensure that the property is clean, well-organized, and appropriately staged before my arrival for the scheduled photography session. I am not liable for any issues related to the cleanliness or tidiness of the property as it appears in the final images. Clients are encouraged to prepare the property in advance by decluttering, cleaning, and arranging furniture and decor items to achieve the desired appearance. Clients acknowledge and accept that they are solely responsible for the property's presentation during the photography session. • Clients are required to submit full payment for the services rendered before being granted access to download the final images. Upon receipt of payment, clients will receive a unique link and/or login credentials that enable them to download the high resolution images from a secure online gallery. Access to the gallery and the ability to download images will remain restricted until the payment has been received and confirmed. By agreeing to these terms and conditions, clients acknowledge and accept the requirement to remit payment prior to obtaining the images.
